1. Scope of Services

Service includes application of herbicide to rock beds, mulch beds, and other agreed-upon non-turf landscape areas only, as specified on this invoice.

Unless otherwise stated in writing, service does not include:

  • Hand pulling or mechanical weed removal

  • Removal of dead weeds after treatment

  • Lawn/turf applications

  • Tree or shrub trimming

  • Debris hauling

Only areas listed on the invoice will be treated.

 


 

2. Licensed & Legal Application

All herbicides are applied in accordance with:

  • Colorado Department of Agriculture regulations

  • Federal and state pesticide laws

  • Manufacturer label instructions

Products used are EPA-approved and applied as directed by label requirements.

 


 

3. Results & Effectiveness Disclaimer

  • Visible results typically appear within 3–14 days.

  • Some weeds, especially perennials, may require multiple applications.

  • New weeds may germinate after treatment.

  • Complete or permanent eradication of weeds is not guaranteed.

Effectiveness may be reduced due to weather, irrigation, soil conditions, or weed species.

 


 

4. Weather & Environmental Conditions

Service may be rescheduled due to unsafe or unsuitable conditions, including:

  • High wind

  • Rain

  • Extreme temperatures

Company is not responsible for reduced effectiveness if rainfall or irrigation occurs within 24 hours of application.

 


 

5. Client Responsibilities

Client agrees to:

  • Provide clear and safe access to treatment areas

  • Remove or identify sensitive plants prior to service

  • Follow all post-treatment safety instructions

Company is not responsible for damage to plants not disclosed prior to service.

 


 

6. Pet & Child Safety / Entry Restriction

Client acknowledges that herbicides require proper drying time before re-entry.

  • Treated areas must remain undisturbed until completely dry.

  • Drying time typically ranges from 1–4 hours, depending on temperature, humidity, and sunlight.

  • Children, pets, and all individuals must be kept off treated areas until fully dry.

  • Once dry, products are considered safe when applied according to label directions.

Client assumes full responsibility for restricting access to treated areas during the drying period.

Company shall not be liable for exposure, injury, illness, or claims resulting from failure to follow these instructions or from premature entry into treated areas.

 


 

7. Drift & Non-Target Damage

While reasonable precautions are taken to prevent herbicide drift:

  • Company is not responsible for damage to adjacent plants unless caused by proven negligence.

  • Environmental factors such as wind may affect application.

 


 

8. Pre-Existing Conditions

Company is not responsible for:

  • Pre-existing plant disease

  • Prior chemical damage

  • Irrigation issues

  • Poor soil conditions

  • Existing landscape damage

 


 

9. Limitation of Liability

Company’s liability is strictly limited to the amount paid for the specific service rendered.

Under no circumstances shall the company be liable for incidental, indirect, or consequential damages.

 


 

10. Payment Terms

  • Payment is due upon receipt unless otherwise agreed in writing.

  • Late payments may incur a $15 late fee after 15 days.

  • Client agrees to pay all collection costs and legal fees if required.

 


 

11. Cancellation Policy

A minimum of 24-hour notice is required to cancel or reschedule service.

Missed appointments without notice may result in a $20 service fee.

 


 

12. Recurring Service (If Applicable)

For recurring service agreements:

  • Service will continue until canceled in writing.

  • Price adjustments may occur with 30 days written notice.

 


 

13. Indemnification

Client agrees to indemnify and hold harmless the company from claims arising from:

  • Failure to disclose sensitive plants

  • Failure to follow post-treatment instructions

  • Unauthorized or premature entry into treated areas

  • Client negligence or third-party interference

            Failure to inform company of issues within 48 hours of application

 


 

14. Acceptance of Terms

Payment of this invoice constitutes acceptance of all Terms & Conditions listed above.
